Uninsured and Underinsured Motorist Claims


If you've been injured by a driver operating his or her vehicle without insurance, and you've been injured, you are still covered for your damages. Your claim will be with your own insurance company under the UM/UIM coverage that is automatically part of your auto coverage. It's required by state law and if you carry liability insurance, you're covered. Covered for medical bills, pain and suffering, time missed from work, loss of the enjoyment of life and more, all up to the limits of your coverage.

The most frequent question I'm asked is, "Will my own rates go up if I make an uninsured motorist claim?" And the answer is NO, your rates will not go up, because it's an accident that was not your fault.

Uninsured motorist claims apply when you've been hit by a driver without any insurance coverage. It also applies to "hit and run" claims. You are covered, up the to dollar limit of your own UM coverage. If you are reading this, please take a minute to call your insurance agent and find out how much UM coverage you have. If you are a UM or hit and run victim, you absolutely need to know that you are protected adequately. Our state's minimum coverage (the most prevalent coverage amount statewide) of $25,000 per person just isn't enough. I highly recommend UM/UIM coverage with limits of $100,000 per person or more. Medical bills are crazy high these days, and minimum limits coverage of $25,000 could leave you with next to nothing.  

Underinsured (UIM) provides extra insurance to you if you are hit by someone without enough insurance to cover your damages. But there's a catch in Illinois. Your UIM coverage only covers the gap between the other guy's coverage and your own UIM limit. As an example, if you're hurt by a driver who carries a $25,000 policy, and you have a $100,000 limit on your UIM coverage, you would collect $25,000 from the other guy plus up to $75,000 under your own UIM coverage. So, your UIM coverage starts where the other guy's coverage ends, up to the limit of your policy.
